OVERVIEW

This website is operated by ATARUSH LLC (“Company”, “we”, “us”, “our”).

By visiting our site and/or purchasing from us, you engage in our services (“Services”) and agree to be bound by the following Terms of Service (“Terms”), including additional policies referenced herein.

If you do not agree to these Terms, you may not access the website or use any Services.

We sell and ship products worldwide. Orders may be fulfilled from warehouse locations in the United States, Italy, or China depending on availability and logistics optimization.

SECTION 1 – ONLINE STORE TERMS

By agreeing to these Terms, you confirm that you are at least the age of majority in your jurisdiction, or that you have given us consent to allow any minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose.

SECTION 2 – CONTRACT FORMATION

A legally binding purchase contract is formed only when:

  1. The customer submits an order,

  2. Payment is successfully authorized,

  3. ATARUSH LLC sends an order confirmation email.

We reserve the right to refuse or cancel any order for reasons including but not limited to:

  • Stock unavailability

  • Pricing or listing errors

  • Fraud detection alerts

  • Suspicious chargeback risk

  • Incomplete or unverifiable customer information

No contract exists until confirmation email is issued.

SECTION 3 – PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, images, and specifications are accurate.

However, variations may occur due to:

  • Device screen differences

  • Manufacturing tolerances

  • Fabric, texture, or finish variations

  • Lighting conditions

Such variations do not constitute misrepresentation or grounds for refund.

SECTION 4 – PRICING, TAXES & DUTIES

Prices are shown in the selected currency at checkout.

For EU and UK customers, VAT is included where applicable.

For other destinations, customs duties and import taxes may apply unless otherwise specified at checkout.

If a shipment is refused due to unpaid duties or taxes in non-DDP regions, the customer remains responsible for:

  • Return shipping costs

  • Carrier penalties

  • Administrative handling fees

SECTION 5 – PAYMENT TERMS

We accept major credit cards, PayPal, Shop Pay, Klarna, Apple Pay, and other payment methods shown at checkout.

All transactions undergo automated fraud screening.

We reserve the right to request additional verification or cancel any transaction that fails security review.

Digital acceptance of these Terms at checkout constitutes a legally binding electronic agreement under the U.S. E-SIGN Act (15 U.S.C. §7001).

SECTION 6 – PRE-ORDERS

Products marked as pre-order are not ready for immediate shipment.

By placing a pre-order:

  • You secure a production allocation

  • Partial payment may be required at checkout

  • The remaining balance will be charged before shipment

  • Estimated shipping dates are indicative only

Pre-orders represent confirmed production commitments and may not be cancellable once production begins.

SECTION 7 – SHIPPING & MULTI-WAREHOUSE FULFILLMENT

Orders may be fulfilled and shipped from warehouse locations in the United States, Italy, or China depending on availability.

Orders may be shipped in multiple parcels.

Delivery timeframes are estimates and not guaranteed.

Carrier delays, customs inspections, force majeure events, or logistical disruptions do not constitute breach of contract.

Title and risk of loss transfer to the customer upon delivery of the goods to the carrier, except where prohibited by mandatory consumer protection law.

SECTION 8 – RETURNS & REFUNDS

Returns are accepted within 14 days of delivery.

To qualify, items must:

  • Be unused and undamaged

  • Include original packaging and tags

  • Not fall under excluded categories (sale items, underwear, swimwear, certain accessories)

Return shipping costs are the responsibility of the customer unless the item is defective.

We reserve the right to refuse returns that do not meet these conditions.

Loss of value resulting from handling beyond what is necessary to establish the nature and characteristics of the goods may be deducted from refunds in accordance with applicable consumer protection laws.

SECTION 9 – CHARGEBACKS & FRAUD PREVENTION

By placing an order, the customer agrees to contact us before initiating any chargeback or payment dispute.

Filing a chargeback without first contacting ATARUSH LLC may constitute breach of these Terms.

The following may be considered abusive chargeback behavior:

  • Filing a dispute while goods are in transit

  • Filing a dispute after confirmed delivery

  • Filing a dispute without returning goods

  • Filing a dispute due to carrier delays

  • Refusing communication while initiating dispute

ATARUSH LLC reserves the right to dispute all unjustified chargebacks and to submit evidence including:

  • IP address logs

  • Device identifiers

  • Checkout acceptance logs

  • Order metadata

  • Tracking confirmations

  • Communication history

Accounts engaged in fraudulent or abusive activity may be suspended or permanently banned.

SECTION 10 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, ATARUSH LLC shall not be liable for:

  • Indirect or consequential damages

  • Carrier delays

  • Customs delays

  • Lost profits

  • Losses beyond the purchase price paid

Maximum liability shall not exceed the amount paid for the product.

SECTION 11 – GOVERNING LAW

These Terms shall be governed by the laws of the State of Florida, United States.

For customers located in the European Union or United Kingdom, mandatory consumer protection rights under local law remain unaffected.

SECTION 12 – ARBITRATION & CLASS ACTION WAIVER (U.S. CUSTOMERS)

For customers residing in the United States:

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in the State of Florida.

You agree to waive the right to participate in any class action or collective proceeding.

This clause does not apply where prohibited by mandatory consumer protection law.

SECTION 13 – CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page.
